Abstract:

 

Regulatory requirements of Surface mining Control and Reclamation Act (SMCRA)

were compared with those of Corps of Engineers (COE) Section 404 Program to

determine if gaps existed.  Analysis addressed general policies for evaluating

permit applications contained in COE regulations (320.4) and determined the

extent to which these were met by SMCRA requirements.  Also considered were

permitting processes of each program and their provisions for inspection and

enforcement.  Relatively few areas were found where SMCRA did not fully or

adequately meet Section 404 regulatory requirements.  The principal differences

are identified (see Figure A).

Abstract:

 

Corps of Engineers (COE) public interest review for Sec. 10 permits for coal

dredging can be broad enough to include permit conditions that satisfy SMCRA. 

Special conditions were developed by COE Huntington District where a vast

majority of dredging operations exist.  Conditions were designed to meet

environmental, navigational, and related needs identified in that area and

developed to minimize the impact on the environment appear based on best

professional judgment rather than long-term technology assessment of impact. 

Conditions represent balancing of public interest for dredging and satisfy SMCRA

requirements.
