Abstract:

 

Report provides a description of regulatory procedures for reviewing, approving

or denying permit applications to conduct coal exploration, mining, and

reclamation operations under a Federal program of a state.  Scope of manual

includes identification of laws and regulations which relate to the review and

approval process, and it identifies shared responsibilities of Fed/state

agencies involved in the review and approval process.  It also describes

provisions for public participation in the review and approval process and

activities that must be performed during the review and approval process.

Abstract:

 

SMCRA has a variety of adverse impacts on some of land surveyors in 6

Appalachian States.  Estimated number of directly affected surveyors is less

than 500, potential loss estimated between $700,000, and $3.5M yearly and causes

for survey preemption examined.  Public health/safety considered in surface mine

plans appear overstated for most preempted functions except water impoundments. 

Surveyor's inability to meet technology needs embodied in Act appears overstated

due to Act's similarity with technology needs in effect a number of years. 

Informed parties generally agree that the Act be amended for state power.
