A Contractual Agreement
This agreement transfers unrestricted legal
title of the gift from the donor to the Fort Lewis College Foundation
(Center of Southwest Studies account) (hereinafter, "the Center") and its successor
organizations.

ASSIGNMENT OF RIGHTS:
To facilitate the research use of this material, the donor assigns intellectual
property, privacy and publicity rights held in the donated materials. The
donor hereby gives and assigns to the Center of Southwest Studies copyright and
all other rights that the donor has
in (a) the materials and (b)
in such works as may be found among any collections of materials received by the
Center from others. This includes, inter alia, the rights of publication in electronic form (such as
placement on the Internet/Web for access by that medium).
Any exceptions to this assignment of rights are detailed in the following
paragraph ("Restrictions").
RESTRICTIONS:
There are no
restrictions
as to the use of this gift, except those encompassed by the Center's General
Restriction Policy

and any specific restrictions specified hereafter:
VALUE: Please
note the estimated value of your donation: $_________. If a written financial appraisal
is available, please attach a photocopy of it. By
College and Foundation policy, in accordance with federal IRS guidelines,
appraisals are the sole responsibility of the donor. The Center
itself cannot provide appraisals for tax purposes.
We refer you to your attorney/ financial advisor and IRS
Form 8283 instructions and Publication 526
for guidance in this area. (Donors must file Form 8283 to deduct
the value of non-cash gifts if the amount is more than $500.)
FINAL ACCEPTANCE: Gifts
that occupy more than three linear shelf feet must be reviewed by the
Southwest Accessions Committee for acceptance.
DEACCESSIONS: The Center will provide reasonable
custody of the materials. Duplicate materials, materials which
the Center deems unnecessary to retain in the original after having been
reformatted for preservation and/or access, and items that are not germane to
the collection policy of the Center of Southwest Studies shall be handled in
the following manner: (please
